TERMS AND CONDITIONS FOR THE PURCHASE OF TICKETS, ROSE PARTICIPATE EVENTS AND MEMBERSHIPS AND THE USE OF THE ROSE WEBSITE


Welcome to the Rose website. If you continue to browse and use this website, you agree to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Rose Theatre's relationship with you in relation to this website.

1. DEFINITIONS

In these terms and conditions, the following words shall have the meanings set out below:

Booking Form means the series of pages for the booking of Tickets, Rose Participate Events and Memberships set out on the Rose’s website.

Confirmation means the confirmatory note sent to you by the Rose confirming your booking reference and the details of your booking(s).

Contract means any contract for the purchase of Tickets or any other item made between you and the Rose.

Membership means Friends of the Rose or other membership schemes.

Rose Participate Event means any event organised by or taking place at the Rose including, but not limited to, Rose Participate or Youth Theatre workshops, community projects and other staged performances.

The Rose refers to Kingston Theatre Trust, trading as Rose Theatre – registered as a company in England and Wales under registration number 2497984, charity number 1000182.

Ticket means any ticket to attend a performance or any other event offered for sale by the Rose.

2. GENERAL

These terms and conditions relate to the purchase and supply of Tickets, Rose Participate Events and Memberships and the use of the Rose’s website generally. Please read these terms and conditions carefully before purchasing any of the above from the Rose website as by doing so, you accept that these terms and conditions will govern all Contracts.

Age Restrictions within the Rose Theatre auditorium. Children can NOT be unaccompanied in the auditorium under the age of 14. Any child who is accompanying another minor in the auditorium must not be under the age of 16.

The website www.rosetheatre.org is owned and operated by the Rose.

PURCHASING TICKETS AND OTHER EVENTS

If you choose to purchase Tickets, Rose Participate Events or Memberships on the Rose website, your Contract with the Rose will be concluded as follows:

a) Completion and submission of the Booking Form (including the provision of your credit or debit card details) shall constitute an offer by you to purchase Tickets, Rose Participate Events and Memberships subject to these terms and conditions.

b) After you have completed all parts of the Booking Form and submitted it online, the Rose will then charge your credit or debit card accordingly. This in itself does not constitute acceptance of your offer; once payment has been taken, the Rose will send you Confirmation. This Confirmation shall constitute the Rose’s acceptance of your booking. A Contract will be formed once you have received the Confirmation.

c) If the Rose receives a prompt notification that the Confirmation was not delivered successfully, then the Rose will use reasonable endeavours to notify you of its acceptance and the details of your booking by other means.

d) You are entirely responsible for entering your details correctly; by submitting a Booking Form you warrant to the Rose that all details supplied by you are true and accurate. If there are any changes to your details once your booking has been concluded, then it is your responsibility to inform the Rose. You can manage your booking by logging into your account here.

e) The price (including all taxes where relevant) of all Tickets, Rose Participate Events and Memberships booked online, over the phone, in person or by post are displayed on the Rose’s website and/or will be provided to you at the time of booking. These details are based on the best available information to the Rose and the Rose is not obliged to conclude any Contract on these terms.

f) For bookings made online, over the phone, via email, in person or by post the Rose accepts payment by MasterCard, Visa, Rose gift voucher, SOLT token, company cheques and BACS.

g) There are no additional booking or transaction fees for Tickets, Rose Participate Events and Memberships booked online, over the phone or in person.

h) If you make a group booking, you accept these terms and conditions on behalf of all members of the group and are responsible for all payments due from the party.

i) Only persons who are at least 18 years of age are permitted to book Tickets. By booking Tickets, you warrant to the Rose that you comply with this requirement.

j) The Rose reserves the right to place restrictions on the volume of any Tickets or Memberships ordered and the number of places booked for Rose Participate Events.

k) It is your responsibility to check that any Tickets issued to you are accurate.

l) Any purchase of Tickets, Rose Participate Events or Memberships is only valid when processed by the Rose or an agent authorised by the Rose. Tickets, Rose Participate Events and Memberships may not be transferred or resold for commercial purposes or at a premium. If a Ticket or Rose Participate Event is transferred or resold in breach of this condition, the bearer of the Ticket or the person claiming the right to attend the event will be refused admission to the performance or event and any membership(s) you may have with the Rose may be terminated.

m) All Tickets and Rose Participate Events are sold subject to the Rose’s right to make any alterations in the cast or programme details advertised on the Rose’s website or other appropriate location.

3. DELIVERY OF TICKETS

a) You can choose to print your Tickets at home, have them posted to you or collect them in person from the Rose Box Office or another authorised agent. These options are clearly displayed on the Booking Form for those booking online. Please note that if you book Tickets for a performance which is scheduled to take place within five working days of the date of your booking being concluded, your Tickets must be collected in person or printed at home.

b) If you choose for your Tickets to be posted to you, they will be sent by Second Class post. The Rose will not accept any liability for any Tickets mislaid or lost by the Royal Mail.

c) The Rose shall use reasonable endeavours to post your Tickets to the address you provided when you made your booking (or to the billing address of the credit/debit card holder if they are not one and the same) within five working days of your booking being concluded.

4. REFUND AND EXCHANGE POLICY FOR TICKETS AND ROSE PARTICIPATE EVENTS

a) Subject to clauses 4 d), 4 e), and 4 f), the Rose will not refund your Tickets after purchase.

b) Tickets may be exchanged for later performances of the same production (subject to availability) provided that the Rose receives your tickets at least 24 hours before the performance is due to take place (or five working days in case of group bookings). Please note: the Rose is a recieving house as well as a theatre that produces its own work. Due to the nature of such programming, refunds and exchanges for received productions are made at discretion of the show's independent producer. Please contact Box Office for further information. 

c) If you return Tickets for sold out performances, the Rose may, but will not be obliged to, resell them on your behalf. If your Tickets are successfully resold the Rose will refund to you the face value of the Tickets purchased. The Rose will sell all of its own tickets before it will offer returned tickets for resale therefore it cannot guarantee the successful resale of any returned Tickets.

d) Where the Rose is unable to perform a Contract on the date(s) agreed because the performance in question is no longer available or cancelled, the Rose will refund/credit you the face value of the Tickets purchased. In the event of a credit note being issued, this will be valid for 12 months from date of issue.

e) The Rose will issue a refund to you using the same method of payment that you used to purchase the Tickets.

f) Where the Rose is unable to perform a Contract on the date(s) agreed because the Rose Participate Event is no longer available or must be abandoned (including where there are an insufficient number of participants), the Rose will inform you of this and issue you with an exchange or full refund, whatever is most suitable. The Rose will issue a refund to you using the same method of payment that you used to purchase the Tickets.

5. WEBSITE USE

The use of this website is subject to the following terms of use:

a) The content of the pages of this website is for your general information and use only. It is subject to change without notice.

b) The contents of the Rose’s website, including any software, are protected by intellectual property rights and other related rights. No part of the Rose’s website may be reproduced in any form (electronically or otherwise) without the prior consent of the Rose, other than temporarily in the course of using the Rose’s booking service or as permitted by law.

c) This website uses cookies to monitor browsing preferences, please check our Privacy & Cookies Policy for more details.

d) Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

e) Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

f) This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

g) Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

h) The Rose reserves the right to refuse to post onto or remove anything from its website which, in the Rose’s opinion, is objectionable or does not comply with these terms and conditions. The Rose shall not in any way be liable for such actions.

i) If you create, or are provided with, a username, password or any other piece of information as part of the Rose’s security procedures, you must treat this information as confidential. In particular, you must not disclose this information to any third party.

j) The Rose’s website may contain hyperlinks to websites operated by parties other than the Rose. The operation of such websites is outside the Rose’s control and you proceed at your own risk. The Rose does not endorse or sponsor and is not liable for the products, services or content you access through any linked site.

6. DATA PROTECTION

The Rose will collect, store and process your personal details in accordance with our Privacy Policy which can be accessed here or from the Rose’s website homepage.

8. SAFETY AND ENJOYMENT

a) The Rose reserves the right to refuse admission and may request any Ticket holders and Rose Participate Event participants to leave (taking any such appropriate action which may be necessary to enforce this right) before or during performances if it considers it to be necessary or desirable to do so. The Rose may also, on certain occasions, have to conduct security searches to ensure the safety of its patrons.

b) Latecomers will be asked to wait until a suitable break in the performance or Rose Participate Event before being admitted to the auditorium or other venue.

c) Large bags must be left in the cloakroom. The Rose may have to conduct security searches of bags left in the cloakroom. If you do not permit a search to be undertaken, you may not be admitted into the building.

d) The Rose will not permit glass containers to be brought into the auditorium; patrons are allowed to use bio-degradable cups they can decant their drink into.

e) Mobile phones and other electronic equipment must be switched off (not silenced) before entering the auditorium. Unauthorised recording, photography and copying of any artistic performance within the Rose Theatre is prohibited.

f) To be admitted you must be in possession of a valid Ticket. In the case of Rose Participate Events you must have paid for that Rose Participate Event.

g) Unless a performance is expressly stated to permit entry to children under the age of five, children under the age of five are not permitted to enter the auditorium.

h) Please note that strobe lighting, smoke effects and gunshots are sometimes used in productions.

i) The Rose and any authorised third parties may carry out general filming and sound recording in or about the venue. By purchasing Tickets or a Rose Participate Event, you consent to you and your party being included in and to the promotional use of such films and recordings.

9. GOVERNING LAW

These terms and conditions and any Contract concluded incorporating these terms and conditions shall be governed by English law and all disputes shall be submitted to the exclusive jurisdiction of the English courts.
